Business Terms and Conditions- Jan 2018

The following terms and conditions apply to orders placed through this website and by accepting via the button below, you are agreeing to be bound by them. A copy will be appended to you confirmation email, which will be forwarded to you when you complete this transaction. We reserve the right to amend these terms and conditions as required prior to acceptance of any individual order.

1 Our Commitment To You

1.1 Product Quality – While we strive to maintain the highest standard of product quality, if you are not satisfied with the quality of our wine, we will refund your account for the full cost of a particular defective bottle. If you have bought a case of wine, then we will refund the whole case, including delivery, as soon as we have collected the rest of the wine from you, provided, you have only a single bottle has been opened from a case.

1.2 Availability – Some vintages are pre-promoted prior to release from the cellar and availability of particular blends/vintages will run out from time to time. We make every effort to draw your attention to this and if any wines are unavailable, we will email you with suggested alternatives before issuing a full refund if no suitable alternative exists

1.3 Price – If you buy wine from our website and then find the same wine for sale at a lower price within 7 days (excluding product promotions, special offer or in a sale) we will refund the difference.

2 Deliveries / Returns

2.1 Delivery – We offer a 2-3 day delivery service from the date the order has been processed and dispatched subject to availability. Our UK delivery charge is £8.00 for up to 6 bottles a with further charge for every case thereafter to locations in the UK mainland. Please call for a price for delivery to the Scottish Highlands and Islands, Northern Ireland, The Isle of Man, The Scilly Isles and the Channel Islands.

Our Couriers normally deliver Monday to Friday, between 9am and 5pm. If you are not there the driver will leave a card for you to arrange a more convenient delivery time.

2.2: Once our wine has been delivered, in according with these terms and your delivery instructions, it becomes the recipient’s responsibility.

2.3 Returns – It is your responsibility to check your goods on delivery to ensure that they have not been broken or spoiled in transit. You should notify our courier and email us within 24hrs of any damage and we will replace any damaged wine or refund you the cost . We will not consider any claims for breakages of our wines unless the breakage is stated on the delivery documentation. Nothing in this clause shall affect your statutory rights as a consumer.

3 Payment Terms

3.1: All prices are quoted in pounds sterling. The prices include Value Added Tax, unless otherwise specified. Any delivery charges are shown in your basket opposite and will be added to your bill on confirmation of your order.

3.2: We accept payment via the Paypal service, including most charge cards and if required via Cheque by post (made payable English Oak Vineyard – Goods will only be dispatched when your cheque is cleared funds) Please Note As a guide, it will take at least 7 days from receipt of your cheque for your wine to arrive using this method.2

Claims / Complaints

4 Cancellations

4.1: You may cancel your order for any reason prior to dispatch of goods by notifying us by email on sales@englishoakvineyard.co.uk.

4.2: We shall reimburse the price of the wine within 30 days from the date of cancellation.

4.3: Unfortunately, we are unable to reimburse the purchase, delivery and collection charges if cancel your order after dispatch from our cellar, unless the wine is faulty (1.1).

5 Under Age Commitment

5.1: English Oak Vineyard will not sell or deliver wine to anyone who is under 18 years of age. By placing an order you confirm that you are at least 18 years old and legally able to purchase alcohol.

5.2: If you are buying a case of wine for a third party – the recipient must also be over 18 years old. It is an offence to provide alcohol to a minor.

5.3: Our couriers are instructed request appropriate ID if they are in any doubt about the age of the recipient on delivery. If the person receiving the wine is unable to produce appropriate ID, unfortunately our couriers will be unable to complete delivery.

6 Data Protection

6.1: By providing your details to English Oak Vineyard via our web site, you consent to us maintaining your details to inform you of promotions. We may contact you by email from time to time to advise you of new product release or seasonal special vineyard promotions unless you have informed us by email that you do not wish to be contacted for this purpose. Please email ‘unsubscribe’ to sales@englishoakvineyard.co.uk to advise us if you do not wish to receive this service. All data is collected lawfully and maintained in accordance with the Data Protection Act 1998.

6.2: We commit that your personal details will only be passed to a third party where this is necessary to fulfil your order and we will never divulged your details to any other third party for any purpose whatsoever.

7 Warranties

7.1: We warrant that the wines will be of satisfactory quality and fit for their general purpose. Given the distinct nature of wine, do remember that their maturation is a variable process and some wines may no longer be at their peak at their time of consumption. Should this be the case, it will not amount to a breach of warranty.

7.2: Other than as stated elsewhere in these terms and conditions, all warranties, conditions, terms and undertakings, expressed or implied, whether by statute, common law, custom, trade usage, course of dealings or otherwise in respect of the goods and services provided by us hereunder are hereby excluded to the fullest extent permitted by law. Nothing in this Agreement shall affect your statutory rights as a consumer.

8 Limitation of liability

8.1: Except in the case of death or personal injury due to negligence or fraudulent misrepresentation for which no limit shall apply the limitation of our liability to you for direct loss or other loss within the reasonable contemplation of the parties at the time of your order will be limited to £2,500 in respect of any one event or series of connected events.

8.2: Save as provided in clause 8.1, we shall not be responsible to you for any indirect consequential or economic or special loss or damage whatsoever or for any loss of business, loss of contracts, loss of profits or use, any deletion, corruption, destruction or loss or removal of data, loss of goodwill or loss of reputation or any financial loss.

9 Claims

9.1 Claims Process – If you need to claim under our guarantee, then please notify us by email on sales@englishoakvineyard.co.uk including a purchase date and convenient contact telephone number.

9.2 Customer Satisfaction – if you are dissatisfied with our performance in any way, please email us immediately with a clear explanation of the issue. At English Oak, we aim to deal with all complaints fairly and quickly. We will acknowledge your contact within 24 hours of receipt of your email and keep you informed about progress until a satisfactory resolution has been achieved. 10: Other Conditions

10.1: We shall not be liable for any delay in or for failure to perform obligations if that delay or failure is caused by circumstances beyond our control such as, but without limitation, any strike, lock-out or other form of industrial action, war, riot, civil commotion, malicious damage, compliance with any law or governmental order, rule, regulation or direction, accident, breakdown of plant or machinery, fire, flood, storm or Act of God, difficulty or increased expense in obtaining staff, materials, goods or raw materials, failure of ISP or telecommunications provider in connection with the performance of this Agreement.

10.2: These terms and conditions shall be subject to English law and the exclusive jurisdiction of the Courts of England and Wales, We reserve the right to modify these terms and conditions at any time and in any way.

10.3: This Agreement does not confer or purport to confer on any third party any benefit or any right to enforce any term of this Agreement.
